Approved Tydings Amendment Waiver and Carryover Limitation (6/13/2025)

The ESEA Federal programs team is pleased to announce that we have been granted a Tydings Amendment Waiver of state fiscal year (FY) 2024 ESEA funds and state FY 2025 Carryover of Excess Title I, Part A Funds.  Pursuant to the authority granted under section 8401(b) of the Elementary and Secondary Education Act (ESEA), the Maine Department of Education (DOE) received approval for the following  waivers from the U.S. Department of Education (USDOE). 

A Tydings amendment waiver from Section 421(b) of the General Provisions Act, which serves to extend the period of availability of Federal FY 2023/State FY 202 funding of the programs listed below until September 30, 2026. The programs affected by this waiver include:
Title I, Part A of the ESEA (Improving Basic Programs Operated by Local educational agencies (LEAs)

Title I, Part B of the ESEA (State Assessment Formula Grants)
-
Title I, Part C of the ESEA (Education of Migratory Children)
-
Title I, Part D, Subpart 1 of the ESEA (Prevention and Intervention Programs for Children and Youth Who Are Neglected, Delinquent, or At Risk) 
-
Title II, Part A of the ESEA (Supporting Effective Instruction) 
-
Title III, Part A of the ESEA (English Language Acquisition, Language Enhancement, and Academic Achievement) 
-
Title IV, Part A of the ESEA (Student Support and Academic Enrichment Grants) 
-
Title IV, Part B of the ESEA (21st Century Community Learning Centers) 
-Title V, Part B, Subpart 2 of the ESEA (Rural and Low-Income School Program) 

waiver from Section 1127(a) of the ESEA for Federal FY 2024/State FY 2025 Title I, Part A funds 
(i.e., the Title I, Part A funds that will become carryover funds on October 1, 2025) which serves to waive the requirement that limits the Maine DOE’s ability to grant its LEAs with a waiver of the 15 percent Title I, Part A carryover limitation more than once in a three year period.

ESEA, FY26 Consolidated Application (6/6/2025)

The FY26 ESEA Consolidated Application opened on June 1 to ensure that school administrative units (SAUs) have as much time as possible to develop their FY26 ESEA Application. The application is due to Maine DOE by August 1. Please remember that ESEA program allocations are preliminary and still subject to change when final allocations are provided by the U.S. Department of Education (DOE). SAUs should continue to reach out to their regional program manager with any questions or concerns. 

June 6, 2025 Update:  The U.S. DOE released the preliminary allocations for Title I, Part D (Subparts 1 and 2) and Title IV, Part A for Fiscal Year 2026. Our team has calculated the SAU preliminary allocations accordingly. Please note that a placeholder of $100 remains for all other ESEA Title programs. 

FY 26 Allocations and Application (6/4/2025)

The FY 26 IDEA allocations and applications are now open and available to complete for substantial approval. 

To start the application, change the Status of the application to Draft Started. The application is now ready to edit.

Applications are due for substantial approval by June 30th, 2025.

Please remember applications are not fully submitted unless they have been approved by the Fiscal Rep and the LEA Authorized Rep.
